This essay offers a critical examination of Neil Ormerod’s treatment of the debate between Lonergan and Gilson on the question of being. Although this debate concerns a highly technical issue of metaphysics and epistemology, it remains germane and relevant, especially within the field of Christian thought. In Ormerod’s careful and for the most part generous examination of this debate, he argues that being for Gilson is perceived through the senses, whereas for Lonergan being is intended in the questions that arise (...) from the relevant sense data. Where Gilson’s philosophy gives priority to the metaphysics of being, Lonergan gives priority to epistemology and cognitional theory. In arguing for the superiority of Lonergan’s approach to the question of being, Ormerod relies on a fundamental misunderstanding of Gilson’s metaphysics. By appeal to the more recent work of Kenneth Schmitz, this essay proposes a proper understanding of Gilson’s metaphysics as a basis for a more conciliatory relationship between these two giants in modern Christian philosophy who too often are pitted against one another. This paper attempts to show that Charles Taylor’s persuasive and expansive phenomenology, developed primarily in his Sources of the Self, ultimately depends upon an ontology of the human person that remains undeveloped, as he often admits. His fundamentalphilosophical claims stand finally as postulates of practical reason, which nevertheless depend upon a dialogical practice that is grounded in the dialogical nature of the human person. This phenomenological and ethical approach raises persistent epistemological and metaphysical questions. What Taylor does not admit, and (...) what this paper will propose in his stead, is that a more systematic metaphysics in the existential Thomist tradition can help support philosophically both his explicit and implicit ontological claims regarding the nature of the human person. The modern problematic, defined by Kenneth Schmitz, is a widespread acceptance of God’s absence in the culture of the technologically advanced Western societies. Schmitz clearly has been deeply influenced by Karol Wojtyla’s work as both philosopher and religious leader. Pope John Paul II’s Fides et Ratio is notable for its courage in advocating the serious pursuit of truth guided at least in part by the philosophy of being. This essay draws on certain important contrasts in Schmitz’s subsequent meditations upon the (...) transcendental of beauty and its implications for communication and postmodern culture with its emphasis on the human subject. The purpose is to reflect on the special significance of this important contrast, shift, and development that occurs in these aspects of Schmitz’s own philosophy within the tradition of the philosophy of being that has been given renewed definition and importance for our challenging times in John Paul II’s encyclical on faith and reason. Dynamic consent is increasingly recommended for longitudinal and biobanking research; however, the value of investing in such systems is unclear. We undertook a rapid review of the benefits and challenges of implementing dynamic consent by searching five databases (Ovid Medline, Ovid Embase, Scopus, Web of Science, Cumulative Index to Nursing and Allied Health Literature – CINAHL) for articles published up to May 2023 that report on participants’ or researchers’ experience of dynamic consent. From 1611 papers screened, 12 met inclusion criteria. (...) Guided by thematic analysis with an inductive approach, we synthesised 31 benefits and 8 challenges. Benefits included: enhanced participant experience through improved consent management and tailoring; greater participant engagement and retention through increased autonomy, trust and communication; reduced costs and burden and increased accessibility and inclusivity. Participants and researchers also valued additional features that dynamic consent platforms facilitate such as two-way communication and return of research updates. The main challenges included the digital divide and consent fatigue. The papers gave recommendations to mitigate these challenges, for example by supplementing with other communication tools and allowing a broad consent approach, respectively. Overall, dynamic consent was described as a valuable consent approach with many benefits and some surmountable challenges. Most included literature was qualitative, so further research is needed to quantify the impact of dynamic consent on recruitment, retention, and participant experience. Further long-term investigations are necessary to explore whether participants want to and do change their consent over time, as well as the impact of dynamic consent on participant privacy. Critical thinking texts typically treat ethical reasoning as being in principle no different from non-moral types of reasoning. I argue that there are two distinctive types of ethical argument—those which appeal to principles of right and wrong conduct, and those which appeal to consequences—and that they cannot be properly understood or assessed on the basis of non-ethical models of reasoning. The failure to recognize this produces a simplistic understanding of ethical reasoning, and contributes to the view that ethical judgments are (...) mere expressions of personal feelings. (shrink)

There has been a renewed interest in psychology and anthropology in the idea of altered states of consciousness. This paper begins by examining the meaning of this term and the extent to which such experiences are reported globally. The topic of shamanism is then discussed, first with respect to its social functions, and then to what is known about its psychological aspects (which is little). Far more is known about altered states of consciousness (ASCs) as they are expressed in meditation, (...) trance and possession, and channeling, and a number of studies are reviewed, both of individuals and of groups, which illustrate the full extent of ASCs. The following section then goes more deeply into the stimulus situations that are associated with ASCs. This brings the discussion into drugs, attempts at altering the sensorium (music and imagery in particular) and recent technological innovations, peculiar to our time, which deliberately alter our usual state of awareness through feedback principles. In the final section, what is known about the physiology of ASCs is reviewed and also the extent to which these phenomena, including shamanism, are regarded as pathological. As a great number of people across the world utilize the healing aspects of trance, possession and shamanic practices, this aspect is discussed, and lastly the adaptive functions of ASCs are considered, with their context in the history of psychology. This article responds to William Scheuerman’s analysis of Edward Snowden as someone whose acts fit within John Rawls’ account of civil disobedience understood as a public, non-violent, conscientious breach of law performed with overall fidelity to law and a willingness to accept punishment. It rejects the narrow Rawlsian notion in favour of a broader notion of civil disobedience understood as a constrained, conscientious and communicative breach of law that demonstrates opposition to law or policy and a desire for lasting (...) change. The article shows that, according to Rawls’ unduly narrow conception, Edward Snowden is not a civil disobedient. But, according to the more plausible, broader conception, he is. It then identifies some advantages of the broader conception in contemporary analyses of new forms of disobedience, including globalized disobedience and digital disobedience. (shrink)

Patient decision aids enable patients to be better informed about the potential benefits and harms of their healthcare options. Certification of patient decision aids at the national level in the United States is a critical step towards responsible governance—primarily as a quality measure that increases patients’ safety, as mandated in the U.S. Patient Protection and Affordable Care Act (PPACA). Certification would provide a verification process to identify conflicts of interest that may otherwise bias the scientific evidence presented in decision aids. (...) Certification also benefits clinicians who may otherwise face malpractice claims based on harm to patients caused by possible reliance on patient decision aids that are inaccurate, incomplete, or presented in a manner that biases the patient’s decision. Existing work by the International Patient Decision Aid Standards Collaboration could guide the establishment of a certification process within the U.S. This article argues for national certification of patient decision aids and discusses how that may be achieved. Background Paramedicine is a newly regulated profession in Australia and with the introduction of regulation in 2018 for this profession came increased responsibilities – including the introduction of a professional code of conduct. Several countries now have regulation of paramedicine and associated professional codes to guide ethical and professional behaviour. Despite this, there has been no published research into paramedic understanding and use of their professional codes. Objectives To explore Australian paramedics’ use and understanding of their professional code of conduct. (...) Research design: This study used a qualitative descriptive design, underpinned by hermeneutic theory. Reflexive thematic analysis was used to analyse the interview data and identify Australian paramedic perceptions surrounding the use of their code of conduct. Results 11 Registered Paramedics from several states and territories were interviewed. Participants were invited to interview by advertisement on social media and the Australasian College of Paramedicine Web site. Participants had varied professional backgrounds including clinical work, education providers and policymakers/managers. Four themes were identified as follows: Theme 1 – ‘You don’t know, what you can’t know’; Theme 2 – ‘I don’t need the code – the code is for others’; Theme 3 – ‘It’s about time’; Theme 4 – ‘Navigating the new profession’. Ethical considerations: Ethics approval was granted by the Monash University Human Research Ethics Committee (MUHREC) Project ID: 28921. All participants provided informed consent. Conclusions The results of this study suggest that paramedics’ knowledge and use of their code is limited, and participants appeared to mostly rely instead on ‘common sense’ morals. Participants did appear to want to understand the broad concepts of the code more and have this better integrated into the profession. The code was also interpreted as important to the paramedic profession and its new professional status, helping to legitimise it as a health profession in Australia. (shrink)

Population-level biomedical research offers new opportunities to improve population health, but also raises new challenges to traditional systems of research governance and ethical oversight. Partly in response to these challenges, various models of public involvement in research are being introduced. Yet, the ways in which public involvement should meet governance challenges are not well understood. We conducted a qualitative study with 36 experts and stakeholders using the World Café method to identify key governance challenges and explore how public involvement can (...) meet these challenges. This brief report discusses four cross-cutting themes from the study: the need to move beyond individual consent; issues in benefit and data sharing; the challenge of delineating and understanding publics; and the goal of clarifying justifications for public involvement. The report aims to provide a starting point for making sense of the relationship between public involvement and the governance of population-level biomedical research, showing connections, potential solutions and issues arising at their intersection. We suggest that, in population-level biomedical research, there is a pressing need for a shift away from conventional governance frameworks focused on the individual and towards a focus on collectives, as well as to foreground ethical issues around social justice and develop ways to address cultural diversity, value pluralism and competing stakeholder interests. There are many unresolved questions around how this shift could be realised, but these unresolved questions should form the basis for developing justificatory accounts and frameworks for suitable collective models of public involvement in population-level biomedical research governance.
